New BPTO Fee Schedule for 2025

On May 9, 2025, Brazil’s Ministry of Development, Industry, Trade and Services (MDIC) published Ordinance GM/MDIC No. 110 in the Federal Official Gazette, updating the fee schedule for services provided by the Brazilian Patent and Trademark Office (BPTO). The revised fees will come into effect on August 7, 2025.

The full version of the new fee schedule, including applicable discounts, was established by BPTO Ordinance No. 10/2025, published on May 12.

The primary objective of this update is to ensure the financial sustainability of the Office by covering operational costs and generating additional resources to support the expansion of services and investment in technological modernization, in line with growing demand.

It is important to note that no fee increases were based solely on inflationary adjustments. Individual service fee increases (excluding discounts) were capped at 49%, in line with technical guidance from MDIC, a figure significantly below the cumulative inflation rate measured by Brazil’s official consumer price index (IPCA/IBGE), which rose by 102.4% between January 2012 (the date of the last general fee adjustment) and December 2024. After applying all adjustment parameters, the average increase across the fee schedule was 24.1%.
